Terms of Service

1. Eligibility

You must be at least 18 years old to use the Service.

If you are between 13 and 17 years old, you may use the Service only with the permission and direct supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

The Service is not intended for children under 13, and children under 13 may not create an account, submit personal information, or use the Service.

You represent and warrant that you are legally able to enter into a binding agreement and that all information you provide to us is accurate and complete.

2. Nature of the Service

Prayer Journey is a guided spiritual reflection platform. The Service may include Scripture based prompts, devotional content, journaling tools, guided prayer, user reflections, personal prayer entries, church or organization features, analytics, exports, and content generated or assisted by automated systems or artificial intelligence.

The Service is offered for informational, reflective, educational, and spiritual support purposes only. The Service does not provide medical care, mental health treatment, counseling, pastoral counseling, legal advice, financial advice, emergency services, diagnosis, or crisis intervention.

Prayer Journey does not speak on behalf of God, does not provide prophecy, and does not guarantee spiritual, emotional, relational, medical, or financial outcomes.

You remain solely responsible for your decisions, actions, spiritual discernment, and how you use any content generated through the Service.

3. Important Health, Safety, and Crisis Disclaimer

The Service is not a suicide prevention service, crisis response service, emergency service, therapy platform, or healthcare provider.

Do not use the Service for urgent, life threatening, or crisis situations.

If you believe you or someone else may be in immediate danger, call 911 or your local emergency services immediately.

If you are experiencing suicidal thoughts, self harm urges, severe emotional distress, or a mental health crisis, call or text 988 in the United States or contact the appropriate emergency or crisis service where you are located.

We may, but are not obligated to, display crisis resources, warning messages, or prompts to seek immediate help. Such prompts do not create any monitoring duty, rescue duty, therapist relationship, fiduciary relationship, or special relationship between you and Prayer Journey.

4. Account Registration and Security

You may be required to create an account to use some or all features of the Service. You agree to:

1. provide truthful, current, and complete information
2. keep your credentials confidential
3. promptly update any information that becomes inaccurate
4. accept responsibility for all activity that occurs under your account

You may not share your account with any other person unless a feature expressly allows it.

You must notify us immediately at support@prayerjourneyapp.com if you suspect unauthorized access, misuse, or any security breach involving your account.

We may suspend or terminate accounts that are insecure, fraudulent, abusive, misleading, or otherwise in violation of these Terms.

5. User Content

The Service may allow you to submit, create, upload, store, transmit, record, or generate content, including journal entries, prayer entries, reflections, voice recordings, notes, messages, prompts, responses, and feedback. This content is referred to as User Content.

You retain ownership of your User Content, subject to the rights you grant below.

By submitting or generating User Content through the Service, you grant Prayer Journey a worldwide, nonexclusive, royalty free, transferable, sublicensable license to host, store, reproduce, process, adapt, modify, transmit, display, perform, analyze, index, create derivative works from, and otherwise use your User Content solely as necessary to:

1. provide, operate, maintain, support, secure, and improve the Service
2. generate responses, personalized journeys, reflections, prayers, exports, reports, and related outputs
3. troubleshoot, prevent abuse, enforce these Terms, and comply with law
4. create aggregated or de identified analytics, metrics, and service insights that do not identify you personally

You represent and warrant that:

1. you own or control all rights necessary to submit the User Content
2. your User Content does not violate any law or any third party right
3. your User Content does not contain anything unlawful, defamatory, infringing, abusive, threatening, harassing, obscene, sexually exploitative, fraudulent, deceptive, or otherwise prohibited by these Terms

We do not claim ownership of your User Content. However, we may remove, block, refuse, review, or preserve any User Content at any time, with or without notice, if we believe it may violate these Terms, create risk, or be required by law.

6. Acceptable Use

You may not use the Service to:

1. violate any law, regulation, court order, or third party right
2. exploit, harm, or attempt to exploit or harm minors
3. impersonate any person or entity or misrepresent your affiliation
4. upload malicious code, bots, scrapers, spyware, or any harmful material
5. interfere with or disrupt the integrity, performance, or security of the Service
6. access accounts, data, or systems without authorization
7. reverse engineer, decompile, disassemble, or attempt to extract source code, models, prompts, workflows, or underlying systems, except where prohibited by law
8. use the Service to build or train a competing product or dataset
9. submit another person's confidential, private, or sensitive information without lawful authority
10. use the Service to generate content that is unlawful, hateful, violent, sexually exploitative, deceptive, or otherwise harmful
11. use the Service as a substitute for professional medical care, therapy, emergency response, legal advice, or financial advice
12. resell, sublicense, lease, rent, distribute, or commercially exploit the Service except as expressly authorized by us in writing

7. Artificial Intelligence and Automated Outputs

Some content or features may be generated, ranked, summarized, adapted, or otherwise produced through automated systems or artificial intelligence.

You acknowledge and agree that:

1. outputs may be incomplete, inaccurate, outdated, inappropriate, or not fit for your circumstances
2. outputs may resemble content provided to other users
3. outputs are provided as tools for reflection and convenience, not as facts, guarantees, prophecies, or professional advice
4. you must evaluate all outputs independently before relying on them or acting on them
5. Prayer Journey is not liable for decisions you make based on outputs

We may change, suspend, or discontinue any automated or artificial intelligence feature at any time.

8. Spiritual Content Disclaimer

Prayer Journey exists to support time with God, not replace direct prayer, Scripture, wise counsel, local church involvement, or personal responsibility.

Any devotional, reflection, prompt, or prayer provided through the Service is offered as general spiritual content only. It should not be understood as God's direct voice, a guaranteed biblical interpretation for your personal situation, a pastoral ruling, or a substitute for prayerful discernment and wise counsel.

You are solely responsible for weighing content against Scripture, prayer, conscience, and trusted counsel.

9. Church and Organization Accounts

If you use the Service through a church, ministry, employer, school, group, or other organization, that entity may be the purchaser, administrator, sponsor, or manager of your access.

Organization administrators may have certain controls over organization accounts, membership, billing, plan management, usage metrics, exports, and administrative settings.

Where organization reporting or analytics are offered, Prayer Journey may provide aggregated, anonymized, de identified, or otherwise summarized data, metrics, and insights according to the applicable product configuration and privacy disclosures.

We do not guarantee that organization level reports will be suitable for any legal, regulatory, employment, pastoral, safeguarding, or disciplinary purpose.

You acknowledge that if your access is sponsored by an organization, your use may also be subject to separate organization policies or agreements.

10. Voice, Audio, and Export Features

The Service may allow audio playback, voice input, transcription, text conversion, downloads, exports, and similar features.

You are solely responsible for ensuring you have the right to record, upload, or submit any voice, audio, or content you provide.

Transcriptions, exports, summaries, and downloaded materials may contain errors, omissions, or formatting issues. You must review them before use or sharing.

We may limit or disable voice, export, download, or storage features at any time.

11. Subscriptions, Billing, and Auto Renewal

Certain features require payment. By purchasing a paid plan, you agree to pay all applicable fees, taxes, and charges disclosed at the time of purchase.

Unless clearly stated otherwise, paid subscriptions renew automatically for the same billing cycle until canceled.

By starting a paid subscription, you authorize us and our payment processors to charge the payment method you provide on a recurring basis for subscription fees, taxes, and any other amounts you authorize.

You are responsible for keeping your billing information current.

We may offer promotional pricing, introductory offers, church pricing, trials, discounts, or credits. We may modify or discontinue any such offer at any time, subject to applicable law.

You may cancel at any time through your account settings, the payment platform used for purchase, or any other cancellation method we make available. Unless required by law, cancellation stops future renewal charges and does not entitle you to a refund for the current billing period already paid.

All payments are final and nonrefundable except where required by law or expressly stated by us in writing.

If your payment fails, we may suspend, downgrade, or terminate paid features.

We may change pricing at any time. If we do, the new pricing will apply beginning with your next renewal period after notice as required by law.

If you purchase through a third party platform, such as an app store, that platform's billing terms may also apply.

12. Trials and Promotional Access

If we offer a free trial or promotional access period, we may determine eligibility, duration, and feature scope in our sole discretion.

Unless otherwise stated at signup, your paid subscription may begin automatically at the end of the trial period, and you authorize us to charge the selected payment method unless you cancel before the trial ends.

We may revoke or modify trial eligibility at any time.

13. Intellectual Property

The Service, including all software, code, designs, layouts, text, graphics, logos, names, trademarks, trade dress, features, content, compilations, prompts, workflows, and related materials, excluding User Content, are owned by Prayer Journey or its licensors and are protected by intellectual property and other laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, nontransferable, nonexclusive license to access and use the Service for your personal, internal, noncommercial use, or for your authorized internal organizational use if you are using an organization plan.

You may not copy, reproduce, distribute, display, publish, modify, create derivative works from, sell, license, or exploit any part of the Service except as expressly permitted in writing by us.

14. Feedback

If you provide suggestions, feedback, ideas, requests, comments, or recommendations, you grant us a worldwide, perpetual, irrevocable, royalty free, fully paid, sublicensable, transferable right to use them for any lawful purpose without restriction, notice, compensation, or attribution.

15. Third Party Services

The Service may rely on or integrate with third party tools, hosting providers, payment processors, authentication providers, analytics providers, communications tools, text to speech tools, speech to text tools, or other services.

We are not responsible for any third party service, content, hardware, software, or website, even if linked to or integrated with the Service.

Your use of third party services may be subject to separate terms and privacy policies.

16. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, store, disclose, and protect information.

You consent to the collection, processing, storage, transfer, and use of your information as described in the Privacy Policy.

17. Copyright Complaints

If you believe content on the Service infringes your copyright, send a written notice to our designated copyright contact at:

Your notice must include all information required by applicable copyright law. We may remove allegedly infringing content and terminate repeat infringers when appropriate.

18. Suspension and Termination

We may, in our sole discretion and with or without notice, suspend, restrict, disable, or terminate your access to all or part of the Service if:

1. you violate these Terms
2. you create risk or possible legal exposure for us or others
3. your use is fraudulent, abusive, deceptive, or harmful
4. required fees are not paid
5. we believe suspension is necessary for security, maintenance, investigation, or legal compliance
6. we discontinue the Service or any part of it

You may stop using the Service at any time.

Upon termination, sections that by their nature should survive will survive, including sections relating to ownership, licenses, payment obligations, disclaimers, limitations of liability, indemnity, dispute resolution, and survival.

We may, but are not obligated to, retain or delete account information and User Content according to our legal obligations, internal retention practices, and Privacy Policy.

19. Service Availability and Changes

We do not guarantee that the Service will be uninterrupted, secure, error free, current, or available at all times.

We may modify, suspend, limit, or discontinue any feature, content, plan, route, workflow, category, export, report, church feature, voice feature, or automated feature at any time, with or without notice.

We are not liable for any modification, suspension, or discontinuation of the Service.

20. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN AS IS AND AS AVAILABLE BASIS, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

PRAYER JOURNEY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, RELIABILITY, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE OR ANY OUTPUT WILL BE ACCURATE, COMPLETE, SAFE, SECURE, UNINTERRUPTED, ERROR FREE, OR SUITABLE FOR YOUR NEEDS, OR THAT DEFECTS WILL BE CORRECTED.

WE DO NOT WARRANT THAT THE SERVICE WILL PREVENT HARM, IMPROVE SPIRITUAL LIFE, IMPROVE EMOTIONAL HEALTH, OR PRODUCE ANY SPECIFIC RESULT.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRAYER JOURNEY, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTRACTORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS, SAVINGS, USE, OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF PRAYER JOURNEY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

1. THE AMOUNT YOU PAID TO PRAYER JOURNEY FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM
2. ONE HUNDRED UNITED STATES DOLLARS

THE LIMITATIONS IN THIS SECTION APPLY TO ALL CLAIMS, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY.

NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

22. Release

To the fullest extent permitted by law, you release Prayer Journey and its affiliates, licensors, service providers, contractors, officers, directors, employees, and agents from claims, demands, and damages of every kind arising out of or connected with disputes between you and any other user, organization, administrator, church, ministry, or third party.

23. Indemnification

You agree to defend, indemnify, and hold harmless Prayer Journey, its affiliates, licensors, service providers, contractors, officers, directors, employees, agents, successors, and assigns from and against any and all claims, demands, actions, suits, investigations, liabilities, damages, losses, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

1. your use of the Service
2. your User Content
3. your violation of these Terms
4. your violation of any law or third party right
5. your misuse of outputs, reports, exports, or organization tools
6. your negligence, misconduct, fraud, or willful wrongdoing

We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate fully with that defense.

24. Dispute Resolution, Arbitration, and Class Action Waiver

Please read this section carefully. It affects your legal rights.

24.1 Informal Resolution First

Before filing any claim, you and Prayer Journey agree to try to resolve the dispute informally for at least 30 days.

To start informal resolution, you must send written notice to support@prayerjourneyapp.com describing the dispute, your name, your account email, the facts, and the relief sought.

We will send any notice to the email address associated with your account or any other reasonable contact information we have for you.

24.2 Binding Individual Arbitration

Except for the claims listed in Section 24.4, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any subscription, any purchase, any output, any User Content, any privacy or data issue, or the relationship between you and Prayer Journey, will be resolved exclusively by final and binding individual arbitration, not in court.

The arbitration will be administered by the American Arbitration Association under its applicable consumer arbitration rules then in effect, except as modified by these Terms.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.

The arbitrator, and not any court or agency, will have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of this section is void or voidable, except that a court may decide issues relating to the enforceability of the class action waiver.

24.3 No Class Actions or Representative Proceedings

YOU AND PRAYER JOURNEY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE ACTION OR PROCEEDING.

Unless both parties agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not preside over any form of class, collective, coordinated, or representative proceeding.

24.4 Exceptions

Nothing in this section prevents either party from:

1. bringing an individual claim in small claims court, if it qualifies
2. seeking temporary, preliminary, or injunctive relief in court to protect intellectual property, confidential information, trade secrets, or platform security
3. bringing any claim that cannot legally be arbitrated

24.5 Arbitration Procedure and Location

Arbitration may be conducted by video, by documents only, in the county where you reside, or in another reasonably convenient location as determined under the applicable arbitration rules.

If the amount in controversy is small enough to qualify for a documents only process under the applicable rules, either party may request that format.

24.6 Fees

Payment of arbitration fees will be governed by the applicable arbitration rules and law. If the arbitrator finds a claim frivolous or brought for an improper purpose, the arbitrator may award fees and costs to the fullest extent permitted by law.

24.7 Opt Out

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending a written opt out notice to support@prayerjourneyapp.com with your full name, account email, and a clear statement that you wish to opt out of arbitration.

If you opt out, the class action waiver will still apply to the fullest extent permitted by law unless prohibited.

25. Governing Law and Venue

Except where the Federal Arbitration Act applies or where prohibited by law, these Terms and any dispute arising out of or relating to them will be governed by the laws of the State of Indiana, without regard to conflict of laws principles.

For any dispute not subject to arbitration, you and Prayer Journey consent to the exclusive jurisdiction and venue of the state and federal courts located in Indiana, and each party waives any objection based on inconvenient forum.

26. Electronic Communications

You consent to receive communications from us electronically, including by email, in app message, text message where permitted, or by posting notices through the Service.

You agree that all agreements, notices, disclosures, and communications we provide electronically satisfy any legal requirement that such communications be in writing.

27. Changes to These Terms

We may update these Terms from time to time in our sole discretion. If we make material changes, we may provide notice by posting the revised Terms, updating the Last Updated date, emailing you, or using another reasonable method.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service and cancel any subscription.

28. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly incorporated by reference or presented for a specific feature, plan, church account, or promotion, constitute the entire agreement between you and Prayer Journey regarding the Service and supersede all prior or contemporaneous agreements, understandings, and communications relating to the Service.

29. Severability

If any provision of these Terms is found unenforceable, invalid, or unlawful, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

If the class action waiver in Section 24.3 is found unenforceable as to a particular claim and all appeals are exhausted, then that claim must be litigated in court and not arbitrated, while the remainder of the arbitration section will remain enforceable to the fullest extent permitted by law.

30. Waiver

No waiver by Prayer Journey of any provision or breach of these Terms will be deemed a further or continuing waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Prayer Journey.

31. Assignment

You may not assign, delegate, or transfer these Terms or any rights or obligations under them without our prior written consent.

We may assign, delegate, or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, financing, restructuring, sale of assets, or operation of law.

33. California Notice, if Applicable

34. Language

The English version of these Terms controls to the extent any translated version conflicts with it.
